Workers' Compensation

Workers' Compensation Cases

It can be financially devastating when injuries suffered on the job make it impossible to work. Under the New Jersey Workers' Compensation Law, workers who suffer injuries or occupational diseases during the course of their employment are entitled to a variety of benefits from their employers, including medical treatment, temporary disability payments while they are treating and unable to work, and a monetary award for permanent injuries. The dependents, typically spouses and minor children, of workers who die from work-related injuries or diseases are also entitled to benefits.

In some cases, employers or their insurance companies fail to provide injured workers with the medical treatment and temporary disability benefits mandated by law. Significantly, in almost every case, employers fail to voluntarily compensate injured workers for their permanent injuries and disability. As such, the only way to properly protect the rights of an injured worker is to file a workers' compensation case.

In New Jersey, workers' compensation cases are heard by the Department of Labor, Division of Workers' Compensation. Our knowledgeable workers' compensation attorneys have the experience to get injured workers the medical treatment they need and the maximum financial recovery permitted by law. We will file the necessary Claim Petition and guide you through the system protecting your rights every step of the way. Similar to other personal injury matters, our firm only receives a fee on a workers' compensation case when we recover money for the client.

Third Party Actions

In most cases, injured workers are prohibited by law from suing their employers outside of a workers' compensation case. In many instances, however, an injured worker may have a cause of action against persons other than the employer ("third parties"), who contributed to the occurrence of the work-related injury or disease. For example, an employee injured by defective machinery used on the job may have a valid claim against the manufacturer of that equipment for the resulting injuries. Our lawyers will thoroughly investigate and aggressively pursue all available third party actions.

Employer Retaliation

New Jersey Law expressly prohibits employers from retaliating or threatening to retaliate against employees for asserting their rights under New Jersey Workers' Compensation Law. We can help you fight for your rights when an employer breaks the law.
